Privacy Policy

Privacy Statement

This Privacy Policy sets out South Sydney Junior Rugby League Club Limited’s commitment to safeguarding your personal information. It describes the purposes for which we may collect, store, use and disclose your personal information, and how we comply with our obligations under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

This Privacy Policy applies whenever you give personal information to us, when you use our products or services, when you visit our venues, or when we do business with you. It covers your dealings with any entity in the South Sydney Junior Rugby League Club Limited group, including its controlled entities (referred to in this Policy as “we”, “us” or “our”).

Collection of Personal Information

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable. This includes information such as your name, postal or email address, date of birth, image and financial details.

The type of personal information we collect depends on your dealings with us. For example, we may need more information when you apply for club membership (including the production of identification documents) than when you enter a competition.

Where it is reasonable and practicable, we collect your personal information directly from you when you use our products and services, enter into arrangements with us, or come onto our premises. Depending on the product or service we provide, we may also collect personal information from third parties. If you are an agent who has, or is entering into, an arrangement to provide products and services on our behalf, we may collect your personal information from credit reporting agencies.
We also have obligations to collect personal information and identification (including images of you) under anti-money laundering and counter-terrorism financing legislation, gaming and liquor legislation, and other laws that apply to our operations.

Government-Related Identifiers

We may collect government-related identifiers (such as driver’s licence numbers, passport numbers, Medicare card numbers or other identifiers issued by an Australian Government agency or a State or Territory authority) where doing so is reasonably necessary to verify your identity, to fulfil a legal obligation, or where another exception under APP 9 applies.

In accordance with APP 9, we do not adopt a government-related identifier as our own identifier for you, and we do not use or disclose a government-related identifier except where:

  • it is reasonably necessary to verify your identity for the purposes of our activities or functions;
  • the use or disclosure is required or authorised by or under an Australian law or a court or tribunal order; or
  • another exception under APP 9 applies.

Use of Personal Information

We operate a number of businesses which handle personal information. The general purposes for which we collect, hold and use your personal information (and share that information with related companies) include:

  • to identify you;
  • to provide you with the products or services you have requested, and any benefits you may become entitled to;
  • to manage and administer the products or services we provide to you;
  • to protect your use of our products and services, and our ability to provide them;
  • to assess applications for credit, including (where you are an agent providing services on our behalf) obtaining a credit report from a credit reporting agency;
  • to comply with our legal obligations, including obligations relating to the responsible provision of gambling services, patron exclusions, and the preparation of player activity statements;
  • to keep you informed about our products, services and events where relevant to your continued use of them or your preferences; and
  • for quality control purposes and to develop and improve our products and services.

Disclosure of Personal Information

We may disclose your personal information where we are required or authorised to do so by or under an Australian law, or where the disclosure is reasonably necessary to enforce the law. This includes disclosures to regulatory authorities under anti-money laundering, counter-terrorism financing, gaming and liquor legislation.

There are also circumstances in which we may disclose your personal information to another organisation for purposes that are important to help us operate our business. These are described below.

Sharing Information with Other Organisations

We do not sell your personal information.

We will generally only give another organisation access to your personal information where that organisation provides services to us that help us operate our business or provide services to you. We require those organisations to comply with the Australian Privacy Principles and to handle your personal information consistently with this Privacy Policy.

Such organisations include:

  • service providers that help us provide, manage or administer our products and services (including identity verification providers, mail house providers, printers, advertising agencies, postal services, call centres, customer research agencies, and our professional advisers);
  • IT and cloud service providers who host, maintain or support our systems and infrastructure, including testing and upgrading our software;
  • organisations that help us review our business operations and structure;
  • debt collectors and recovery agents; and
  • organisations that help us develop and plan new products and services.

We may also share your personal information with another organisation where you have consented to that sharing.

Cross-Border Disclosure

Some of our service providers (including IT, cloud hosting, communications and analytics providers) may store or process personal information outside Australia. Where we disclose your personal information to a recipient located overseas, we take reasonable steps to ensure that the overseas recipient does not breach the Australian Privacy Principles, as required by APP 8.

The countries in which your personal information is most likely to be stored or processed include [to be confirmed and inserted – typical examples for Australian clubs include the United States, the European Union, Singapore and New Zealand]. We will update this Privacy Policy if our overseas disclosures change in any material way.

Marketing

We may collect and use your personal information to promote and market our products, services, promotions and upcoming events to you (including via The Juniors app, direct mail, telemarketing, SMS and MMS). We will only send you marketing communications if:

  • you have consented to receiving them; or
  • the marketing is related to the purpose for which we originally collected your personal information and you would reasonably expect us to use the information for that purpose.

Our app may collect location data to recognise and reward patrons for visiting us, including when the app is closed or not in use, where you have enabled location services.

You can opt out of marketing at any time by contacting us using the details in the “Privacy Contact and Complaints” section, or by following the unsubscribe instructions in any marketing communication.

Marketing may be undertaken by one or more entities within the South Sydney Junior Rugby League Club Limited group using your personal information.

Marketing Exclusion for Identification Information

Identification information that we collect for the purpose of verifying your identity (including through the Document Verification Service) is used solely for that purpose. It is not used, and will not be used, for:

  • creating a data profile of you or tracking your behaviour (whether online or offline);
  • offering or supplying goods or services to you;
  • advertising or promoting goods or services;
  • enabling another person or entity to offer, supply, advertise or promote goods or services to you; or
  • conducting market research.

Identity Verification

Where you provide identification documents to us – for example, as part of membership, patron sign-in, or anti-money laundering and counter-terrorism financing customer due diligence – we may verify your identity by checking the details on those documents against official records held by document issuers or government record holders. This verification is performed through the Australian Government’s Document Verification Service (DVS), which is administered by the Attorney-General’s Department.

How We Use the Document Verification Service

We submit the details from your identification document (for example, the name, date of birth, document number and expiry date shown on your driver’s licence or passport) to the DVS through an approved Gateway Service Provider. The DVS returns a “match” or “no match” result, which we use to confirm whether the details you have provided correspond to records held by the relevant document issuer or official record holder.

Third-Party Service Providers

The verification process involves the following categories of third-party service providers:

  • Approved Gateway Service Providers, which transmit verification requests and results between us and the DVS (we currently use BNDRY for this purpose);
  • the Australian Government’s Document Verification Service, operated by the Attorney-General’s Department as Framework Administrator; and
  • the relevant document issuers and official record holders against whose records the document details are checked (for example, State and Territory road authorities for driver’s licences, the Department of Foreign Affairs and Trade for passports, and the Department of Home Affairs for ImmiCards and visas).

Our Legal Obligations

Our collection of your identification information is connected to our legal obligations under:

  • the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and the AML/CTF Rules, including obligations to apply customer identification procedures and ongoing customer due diligence;
  • the Gaming Machines Act 2001 (NSW), the Liquor Act 2007 (NSW) and related regulations, including responsible gambling and patron exclusion obligations; and
  • the Identity Verification Services Act 2023 (Cth) and the DVS Access Policy, which set out the conditions on which we may use the DVS.

Your Rights

You have the following rights in relation to the collection of your identification information:

  • to be informed about how your identification information will be collected, used and disclosed;
  • to give or decline consent to the verification of your identity through the DVS;
  • to request access to and correction of personal information we hold about you, as set out in the “Access to and Correction of Your Personal Information” section below; and
  • to make a complaint about our handling of your identification information, as set out in the “Privacy Contact and Complaints” section below.

Consequences of Declining Consent

If you decline to consent to the verification of your identity through the DVS, we may not be able to verify your identity through that channel. Where verification of your identity is required by law (for example, to comply with our anti-money laundering and counter-terrorism financing obligations), we may not be able to provide you with the relevant product or service, or may need to verify your identity by an alternative method. We will let you know if an alternative verification method is available.

Consent Statement

Before we submit a verification request to the DVS, we will ask you to provide your express consent by accepting the following statement. This consent is collected separately from any other agreement, including any membership agreement or terms and conditions:
“I confirm that I am authorised to provide the personal details presented and I consent to my information being checked with the document issuer or official record holder via third-party systems for the purpose of confirming my identity.”

Complaints and Further Information

You can make a complaint about our handling of your identification information by contacting us using the details in the “Privacy Contact and Complaints” section below. You can find information about the operation and management of the Document Verification Service by the Attorney-General’s Department at idmatch.gov.au.

Access to and Correction of Your Personal Information

You have the right to request access to the personal information we hold about you (APP 12), and to request correction of any personal information that is inaccurate, out-of-date, incomplete, irrelevant or misleading (APP 13).

To make a request, please contact our Privacy Officer using the details in the “Privacy Contact and Complaints” section below. We will:

  • acknowledge your request promptly;
  • respond to your request within 30 days; and
  • provide a written explanation if we are unable to give you access or make a correction, including your options for making a complaint.

We do not charge a fee for making a request, although a reasonable fee may apply for giving access in some circumstances. Player activity statements are available on request from club management.

Surveillance of Venues

The Juniors Group of Clubs is subject to video, facial recognition technology and at times audio surveillance for security, safety and legal compliance reasons. Surveillance footage and related data are retained in accordance with our surveillance system’s standard retention period and applicable legislation.

Details of suspected or actual illegal and undesirable activities on our premises may be shared with law enforcement and regulatory bodies without your consent, as permitted by law.

Security of Personal Information

We take reasonable steps to protect your personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure, as required by APP 11. These steps include:

  • encryption of personal information in transit and, where appropriate, at rest;
  • role-based access controls and authentication requirements for staff and contractors who access personal information;
  • physical security controls for our premises, servers and storage facilities;
  • regular privacy and information security training for staff;
  • vendor due diligence and contractual privacy and security obligations on our service providers; and
  • incident response and breach notification procedures.

If we suspect or become aware of a data breach that is likely to result in serious harm to any individual whose personal information we hold, we will comply with our obligations under the Notifiable Data Breaches scheme in Part IIIC of the Privacy Act 1988 (Cth), including notifying affected individuals and the Office of the Australian Information Commissioner (OAIC) where required.

Data Retention

We retain personal information only for as long as necessary for the purposes for which it was collected, or as required by law. Retention periods vary depending on the type of information and the legal requirement that applies. In particular:

  • AML/CTF records: we are required to retain customer identification records, transaction records and other AML/CTF records for at least 7 years, in accordance with Part 10 of the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and the AML/CTF Rules;
  • responsible gambling and patron exclusion records: retained for the period required under the Gaming Machines Act 2001 (NSW) and related regulations;
  • surveillance footage: retained for the period required by applicable legislation and our surveillance system’s standard retention period;
  • member and patron account information: retained while your account is active, and for a reasonable period after your last interaction with us, unless a longer retention period is required by law; and
  • marketing preferences: retained for as long as you continue to receive marketing communications from us, plus a reasonable period to evidence your preferences.

Account Deletion

You can request deletion of your account or personal information at any time by:

  • using the “Delete Account” option in the app; or
  • contacting our Privacy Officer at privacy@thejuniors.com.au.

When you request deletion, we will remove or de-identify your personal data within a reasonable timeframe (typically within 30 days), except where we are required or authorised to retain certain information for legal, regulatory, security or fraud prevention purposes (including the AML/CTF retention obligations described above).
